The witness testified that on Friday January Si. his attention was called to a young man and young woman in the Grand Central Depot on that day by Depot Watchman Patrick Kinney, and that the young man was not Alonso Wailing.

The witnesa waa positive In his statement that the young man was not Walling. He de- scribed the young man'a clothing, and remembered distinctly that he wore a watch chain. He waa asked repeatedly as to the possibility of the young mas being Wailing tu he sa1 there waa not the slightest doubt in hla mind that Walling waa tot the man to whom Watchman-Kinney had called hla attention on Friday at the Grand Central Station. It was a two-seated cavb. and waa drawn by a gray horse. He heard it belonged to Chester Mullen. He had gone over the awme roote as was described by George H. Jackson.

When the Three title Creek hill was reached the horse balked, and three of the passengers were compelled to get out. Arter making two or three stops the top of the hill was reached. The horse was badly winded. Cm cross-examination witoees said that a bolt came out of the shaft. The damage waa repaired and the )ourney continued.

The witness waa eublected to a searchina' examination. He stated that the start was made at TC o'clock in the evening, and was ended at He acknowledged that he knew nothing about the speed of a horse. Harry O. Martin, of 041 McMillan street. Walnut Hills, testified that he waa ensaaed In the llvee-y Witness deposed that a party had called on him on January 31 and wanted to hire a rig.

The man who called on me on that day was, to my knowledge, not Alonso Wailing. To' the beat of my belief the man wss not Walling.
