In a decision handed down to-day, reversed the Mingo County Circuit Court la the case of the Bank of Williamson, of Mingo Coun ty, vs. the McDowell Count Bank, of Welch, and established the law that In taking a forged check from an unknown person for collection, without Inquiry as to his Identltv 1.

A stranger presented a check to the McDowell County Bank. Indorsing It as Oeorge Horner. The McDowell County Bank cave Its Indorsement to the check, and the Bank of Williamson, through the Mingo County Hank, deposited $800 with the McDowell County Bank. It later developed that the check was a forgery, and the Bank of Wil liamson brought suit for the recovery of I -Uie money from the McDowell County Bsnk. Judge Brannon dissented from the opin ion.

The detectives chased him In and out of alleys and over back fences for two or three squares, and then Franks ran Into a blind alley behind a building. De tective Calnan followed with his revolver drawn and Franks surrendered.

Franks admitted the cutting, but said he had done It In self-defease. He said he had been attacked by the white man and a negro and was hit in the bead with a brick, so he defended himself with a pocket-knife. He said he would have remained in Columbus had It been that he was a stranger there arid had no while the other men had some Influence.
