BY CAYLORI) BINDER One of the most notorious fiunmen Cincinnati has ever known, locked within the fortress-like walls of the Ohio Penitentiary for the last 20 years, will be eligible to appear before the parole board in May, If the board recommends that the governor reduce 4this sentence to second-degree murder, he will be eligible for parole.

It does rot have to make the recommendation. i( Robert Zwick, now 53, the product of prohibition's era of bootlegging gangland rides and general violence, plods aloof and tntalkative from office to office carrying messages. He has held the messenger job since 19-1G. His hair is thinning, his hair line receding. A conspicuous bullet scar runs from his nose to his mouth on the left side of his face.

Zwick' prison record has been remarkably good. But there was a time when his record wasn't so good. In the days of prohibition he was known to the police as "the Fox," the elusive desparado suspected in seven killings and at least two bank robberies. To Zwick himself, he was only a liquor runner, and a proverbial "dog with a bad name." The "Fox" ran before the law for nearly five years before he was dropped by police bullets on a Toledo street January 6, 1933. Three months later, his chin still bandaged, his Jaws wired together and abscesses plngrulng him, he stood convicted of the brutal shooting, slashing and burning of the witness to a murder In 1928.

Sentenced for life, be entered the penitentiary April 18, 1933, and became convict No. 66,889. Zwick started life as one of the nine children of a family of moderate means, living near a Cincinnati church and infrequently attending it. lie became an apprentice boilernviker, and then, jast how and when has never been established, he exchanged the clatter of a boiler-shop for the rumble of liquor trucks and rattle of machine guns. Rodney Ford was captured In Zwick' ear In Cincinnati's West End. Zwick, an occupant of the car, escaped. Ford died In the electric chair 'for his part in the Dumele slaying, A week later police captured John (Toddy) Messner, a liquor circles character. A few days later rircck Lutes was caught. Messner was given life ana is eligible to appear before the parole board in March, 1954.

Lutes, also given life, won a commutation to second degree murder and was paroled after serving more than 20 years. Rober Andres, one of the dice players who identified Ford at a preliminary hearing, disappeared on December 12, 1928, while working as a clerk for the Chesapeake and Ohio Railway in Covington. His charred body was found In the blazing ruins of a roadside market on West Miami River Road, near Venice, 18 miles from Cincinnati. He had been shot in the back, and slashed with a knife, and his tongue cut out. A witness later testified in court that Zwick had' derived personal pleasure in cutting out Andres' tongue because he was a "squealer." On the night of May 27, 1929, an automobile In which Zwick was seated was riddled with tommygun bullet.

"Turkey Joe" Jacobs, owner of the car and gangland figure, was killed. The police counted 16 bullet holes In hi in. Zwick also was wounded In his thigh and with two fingers blown off his left hand, cheated death, possibly because of the bullet-proof vest he wore. He was taken to a Newport doctor by his girl friend, "Dago Rose," Calandrllln, whose name was frequently linked to a Newport brothel. The underworld made another attempt to rub out Zwick on the nicht of December 22, mother of Charles F.

Taken to Good Samaritan Hospital by police, he refused to identify his assailants.

Released from the hospital, he escaped the vigilance of detectives assigned to watch his movements. (These were not the only events that displayed Zwick' charm against death. He earned that reputation long before he became a gangster. On June 7, 1921, lv years before he became known racketeer, he was the driver of an automobile containing three other men and four women. Clipping along at a fast pace, the automobile spun out of rontrol and crashed over a 75-foot embankment on Cheviot Pike, between Cheviot and Miamltown.

Despite his activities as a liquor runner, freely admitted later in cnirt, and despite an occasional brush with rivals that attracted attention, the police of Southern Ohio and Northern Kentucky did not become deeply interested in Zwick until April 8, 1928, Shortly after midnight on that day, five bandits, four of them masked, stalked Into the I'ellcan Club pool room In North College Hill.
