GRACZYK Associated Press HUNTSVILLE, Texas-The Supreme Court on Friday upheld the use of drugs in executions, clearing the way for a lethal Injection for Ronald Clark O'Bryan, convicted of killing his eight-year-old son with cyanide-laced Halloween candy.

O'Bryan, dubbed "Candy Man," was scheduled to be executed today. The Supreme Court twice on Friday rejected appeals in the case. After the court first refused to block the execution, U.S. District Judge John Garrett Penn ordered the Food Drug Administration to seize the drugs, which O'Bryan's attorneys argued had not been approved for such use by the FDA. Penn's order was stayed a few hours later by a Washington, D.C., appeals court, and no legal barriers to the execution remained, said Elna Christopher, spokeswoman for the Texas attorney general.

THE SUPREME Court declined late Friday to stop the execution after reviewing the drug issue, an appeal termed by O'Bryan's attorney, Stefan Presser of the Texas American Civil Liberties Union, as "a one in a million chance." "I'm afraid he's going to die tonight," Presser said after the ruling was Issued. As preparations for the execution continued, O'Bryan ate most of a final supper, including T-bone steak and Boston cream pie, said a Huntsvllle prison spokesman. Earlier Friday, O'Bryan "appeared calm and walked under his own power" to the holding cell outside the death chamber, said Rick Hartley, spokesman for the Texas Department of Corrections. GOV. MARK White said Friday he would not issue a 30-day reprieve.

"I've always associated fear with guilt, and guilt with fear," O'Bryan, nicknamed the Candy Man by fellow Inmates, said in a recent Interview. "Because I have no guilt, I've really got nothing to be scared about." O'Bryan's attorneys had argued the lethal injection of sodium thiopenthal, Pavulon and potassium chloride constituted cruel and unusual punishment. A similar argument failed to sway the Supreme Court nearly three weeks ago when convicted killer James David Autry was put to death in Texas. O'Bryan, 39, won three earlier stays, but earlier this week, the Supreme Court rejected his request for a new trial. Fifteen other men have been executed since the Supreme Court reinstated the death penalty seven years ago.

The death row population nationwide has since swelled to more than 1,200 people. PROSECUTORS said O'Bryan used cyanide to spike five Giant Pixy Stix-22-inch plastic tubes filled with powdered confection -in 1974. He said he got the candy from someone while trick-or-treating with his children. Eight-year-old Timothy received one of the candles, and Elizabeth, O'Bryan's flve-year-old daughter, got another. Three others went to children In the suburban Houston neighborhood, but only Timothy ate the candy.

He died soon after. Prosecutors said O'Bryan called a bank the next day to ask about collecting on a $10,000 insurance policy he had taken out on Timothy. There were other policies, adding up to $31,000 on each child. The crime changed the way Texas youngsters, particularly those in the Houston area, celebrate Halloween. Some neighborhoods informally banned distribution of candy.
