Griffin of Michigan to strip federal courts of power to order busing in school desegregation cases was brought up again by Sen. Robert Dole of Kansas, the Republican national chairman, just before the passage vote. Senate passage of the mammoth education bill, which covers many subjects besides busing, sent it to conference with the House. The congressional stand on busing finally will be decided in that conference since the House did include three stiff antibusing amendments when it passed the legislation last November. WASHINGTON (AP) -The Senate turned down by one vote a effort to revive the Suit Seeks Delay In Tax Petitions COLUMBUS (UPI) Five House Democrats filed a lawsuit Wednesday to delay certification of pilot petitions submitted by a group of House Republicans seeking to halt collection of the state income tax and put it to a vote of the people. The suit, filed in Franklin County Common Pleas Court, asked for a temporary injunction against certification by Attorney General William J. Brown, also a Democrat.

A hearing on the request was set for March 13. The Democrats also asked that the court take jurisdiction in giving direction to the form and content of the petitions and proposed constitutional question designed to stop the income tax. The said the Republicans must explain in their summary of the proposed constitutional amendment that elimination of the income tax would cost the state $357 million in corporation and individual tax revenues. Filing the suit were Democratic Reps. Harry J.

Lehman, Shaker Heights; John G. Sweeney, Cleveland Heights; Richard F. Celeste, Lakewood; Arthur R. Wilkowski, Toledo and Donald J. Pease, Oberlin.

"We are not attempting to block the constitutional amendment," Lehman said. "But if it is to be done, it should be done in full compliance with the law." The Republicans, headed by Rep. Joseph P. Tulley (R-Mentor) must get their pilot petitions approved by Brown as to form and content before circulating them statewide. Then they must obtain 318,414 valid signatures of registered voters to get the issue on the ballot in November.

Some 3rd Class Mail Rates Higher March 12 WASHINGTON (AP) The U.S. Postal Service announced Wednesday temporary rates on some third class mail will be raised March 12. The major change will be a new higher five-cent minimum per piece charge applying principally to advertising circulars. The present third class bulk postage rates for certain groups, authorized to mail at reduced rates as nonprofit organizations, are not affected by the announced increase, said the service. Neither are key and certain identification devices customarily mailed as third class.

The increase announcement comes at the heels of a successful appeal by the Postal Service rom a January 17 U. S. Distreit Court judgment that denied the Postal Service authority to put a temporary third class increase effect January 24 as it had The pending increases will affect certain third class mail categories: Regular bulk rate for circulars: goes up to 28 cents a pound or a five-cent minimum per piece charge, whichever is higher. The present regular bulk rate of 23 cents per pound, and a variable minimum per piece charge of four cents and 4.2 cents will be 'eliminated. The four-cent minimum per piece has applied up to the first 250,000 pieces mailed in a year; the 4.2 minimum per piece has applied to quantities above 250,000 pieces mailed annually.

Regular bulk rates for books and catalogs: Will increase to 21 cents a pound and a minimum five cents per piece charge, whichever is higher. The new rate will compare with outgoing rates of 17 cents a pound and 4 cents variable minimum per piece that has applied to bulk rate circulars. Single piece third class rate used largely for small parcels and printed matter: Will be raised for mail pieces weighing more than three ounces. Increases will range from one to nine cents above current charges, depending upon weight. A present single piece rate of eight cents for the first 2 ounces and 2 cents for a third ounce will continue to apply for mail pieces weighing up to three ounces.

Ten cents for a single piece weighing between two and three ounces. The rates for printed matter and small packets to Canada and Mexico also have been increased to correspond with the new third class rates for domestic mail. Spy Satellite Launched Under Hush-Hush Air CAPE KENNEDY, Fla. (AP) Under a mantle of secrecy, the Air Force has launched a spy satellite, reportedly the third in a series intended to monitor Russian and Communist Chinese rocket tests and to give almost instant warning of a missle attack on the United States. Sources reported the payload carried sensors capable of detecting both land and submarine launched missiles and nuclear explosions in the atmosphere.

The Air Force's most powerful rocket, a Titan 3, blazed away from Cape Kennedy at 4:38 a. m. Wednesday to propel the secret payload toward a stationary orbit 22,300 miles above the earth. Newsmen were not notified in advance of the launching. Sources said the satellite was the third launched here under a project with the code name 647.

They said the first was launched in November, 1970, but failed to achieve a proper orbit.
