3 cious cious Defy Law, Remove Kidneys Of Slaying Victim NEW YORK (AP) Over stiff opposition from the medical examiner, surgeons at Jacobi Hospital took the law in their own hands Friday, and removed the kidneys of a 20-year-old man who was fatally shot. The surgeons said the kidneys were needed for transplants. But Medical Examiner Dominick DiMaio said it was mandatory an autopsy be performed on the intact body of the victim, Danny Sulsona, because it was a case of murder and the precise cause of death was. vital to any prosecution. However, the hospital said that the time required for an autopsy would leave the kidneys unfit for transplant.

Said George Kalkines, general counsel for the Health and Hospitals "I know we're risking a misdemeanor for disturbing evidence in a criminal case. But there are people out there waiting for kidney transplants and we just aren't going to stand on ceremony." Siding with the hospital was Bronx Dist. Atty. Mario Merola, who said: "I will not stand in the way of saving other lives for a technicality." ONLY 24 HOURS earlier, the Health and Hospitals Corp. had bowed to pressure from DiMaio's office and let another gunshot victim, Richard Smith, 27, of the Bronx, go to autopsy without removing his kidneys.

"And because of that we lost two kidneys," a hospital official said angrily. In both cases, permission for the kidney transplants had been given by families of the dead men. Both men had been kept technically alive for hours in heart-lung machines. "The problem is cause of death," DiMaio maintained, "and I'm the only one who can determine that, not the doctors at the hospital. If the victim had died within three, even six hours of the shooting there.

would have been no question in my mind that he died of the gunshot wound, based on what the doctors at Jacobi have told me. But they've been able to keep him alive for more than 18 hours with the heart-lung machine. Cause of death becomes a bit more blurred as a result." were and are prepared to prosecute both cases," DA Merola said. "These were gunshot wounds in the head." Sulsona was found shot in the head Wednesday night in the South Bronx. Doctors said his brain wave responses gave out a few hours later, but the heart was kept beating.

Kalkines said he intended to seek a court ruling that an individual is dead when his brain ceases to function. Ford Still Optimistic On GOP's Prospects New York News WASHINGTON Conceding that the dispirited Republican Party has "hit its lowest point," President Ford told 2000 GOP leaders and party activists Friday that from now on, the party's fortunes are "going Mr. Ford did not say how this reversal would be accomplished, but in a cheerleader type speech to mark the closing session of a Republican leadership conference, he said, "I intend to run for President (in 1976) and I intend to The President's appearance at the conference was almost the only bright note of the three-day session, which saw a parade of speakers with only bad news for the GOP. He called on party leaders for their part to work with him in expanding the party's base, declaring "we must discard the attitude of exclusiveness that has kept the Republican Party's door closed too often while we give speeches about keeping it open." National Party Chairman Mary Louise Smith reported frankly to the conference: "The Republican Party is in trouble. Unless you and I get together and work for this party, we may have no party at all." A former national GOP chairman, Sen.

Robert J. Dole agreed. "At least in terms of numbers, the Republican Party is today in worse shape than it has ever been before in its Dole said. "Our numbers have been declining continuously over the last two decades and conceivably this may only be the current low. It could get Rep.

John Ashbrook (R-Ohio) said in a statement handed out to delegates: "The Republican Party has always stood for law and order and clean government. It was a Republican President and vice president, however, who were forced to resign in disgrace, and the very highest officials of a Republican administration have been sentenced to serve 2 and years in prison." Bliss Says GOP Loss Less Than Democrats' By ROBERT WEBB Washington Bureau Chief WASHINGTON Former Republican National Chairman Ray Bliss said Friday the proportion of Americans calling themselves Democrats has dropped or since 1965 when he came to the GOP helm. "But the percentage for Republicans has dropped only about six points," Bliss, of Akron, said. "The Democrats had around of the people identifying with them in 1965, in wake of the GOP debacle of 1964. The Republicans had or His remarks came when asked his reaction to a survey report to the GOP National Committee that only of Americans identify as Republicans today.

"The Democrats were down to around 41 or when I left the chairmanship in April, 1969, and they're still down to around 42 or Bliss said. One of three Ohio members of the Republican National Committee and a member of the party's National Executive Committee, Bliss predicted that "if we can get the right candidates for 1976 for the major offices, including governor and U.S. senator, we'll do all right. People vote more independently for candidates for the major offices than they do for those as they get down the ticket toward county auditor." Bliss said affinity for party becomes most significant when the ballot must be marked for candidates none of whom is well known to the voter. "Then the tendency is to vote for the candidate by party," he said.

Bliss was here for the National Committee meeting which wound up Thursday and for the GOP National Leadership Conference which began Court Asked To Rule On Bills COLUMBUS, Ohio (AP) Ohio Attorney General William J. Brown Friday asked the Ohio Supreme Court to force Gov. James A. Rhodes to file the secretary of state six bills passed by Democrats two days before Rhodes took office. Brown, in a mandamus action, also asked that Secretary of State Ted W.

Brown be forced to accept the bills, which had been signed by former Gov. John Cilligan. The bills were not signed by former Lt. Gov. John W.

Brown, presiding officer of the Senate at the time of passage. The secretary of state claimed he couldn't accept them because Gilligan was no longer governor when they reached Ted Brown's office. They were turned over to Rhodes' office. Democrats, who control both houses of the legislature, rammed the partisan bills through during the first six days of the session, while Gilligan was still in office.
